Equity and Trusts Essay Example | Topics and Well Written Essays - 1000 words - 1

Equity and Trusts - Essay Example The formal declaration is not subject to any alteration and therefore settles any dispute that would possibly arise from the process of sharing the property. A will is a binding document that is always not subject to any form of alteration. Alan Jones leaves behind a will elaborating how he would wish to share his wealth. The terms of the will just as is the situation with any other are legal terms and therefore require effective analysis and interpretation. Everyone referred to in the will must receive the resources allocated to them and utilize the resources as directed by the deceased. This implies that the lawyer does not only oversee the interpretation of the will by making the terms understandable to the parties but also ensures that the specific parties carry out the mandate bestowed upon them by the author of the will (Ross, 2004). In his will, Alan Jones begins by allocating his former wife, Lucinda an amount of money worth five hundred pounds. In the directive, Alan says th at he hopes the woman puts the money in a trust to help the Ilchester animals sanctuary so that the money helps the sick animals in the sanctuary (Garth, 1998). The terms of the will in relation to the former wife are liberal. Alan gives the woman the amount and in so doing, he bestows on her the mandate to invest the money as she wishes. He later advises that the woman invests the money in a trust, the tone of the directive is an advice and so, the woman has no prerogative to comply with it. He says that he wishes she invested the money in trust to help sick animals in the sanctuary. Despite this, the woman has the right to invest the money as she so wishes only that it would make him happier if she did invest the money in the trust as he advises (McKendrick, 2012). From the composition of the directive, it is possible Allan knew that his former wife and a passion for conserving the animals. He, therefore, presumes that the receipt of such an amount would help her realize her dream of reaching out to the animal orphanage. This information compels Alan to advise her to do so with the money. Possibly, the woman may decide to invest the money in the trust as he advises but the terms of the will does not bind the stakeholders to use the money in the assistance of sick animals since this again is another random advice such he believes that the sanctuary protects only sick animals (Amsterdam & Bruner, 2002). The sanctuary after receiving the money has the authority to invest it in a manner they deem necessary since the terms of the will do not influence their budgetary allocation and internal operations. In the second sentence, he gives his two houses to his brothers Kip and Tim. He makes it clear on the location of the houses by naming thereby making it clear that the two houses include the one on number 12 High Fullchetser while the other in 42 High Ilchester. By naming the location of the houses, Alan makes the will clear and does not, therefore, create confusio n with any other interested parties on the two houses. On the same sentence, he says that Kip to have the first choice, a depiction of presence in which he apportions his brother Kip the chance to choose either of the house before his other brother Tim. Kip, therefore, makes the first choice on which house to retain after which Tim retains the other.     Ã‚

Policy Making Essay Example | Topics and Well Written Essays - 1250 words

Policy Making - Essay Example The contacts can be found in a government directory. The next step is initiating contact. This involves calling the offices or traveling to the offices personally. If an appointment is granted, the plan moves to the next part which involves correspondence on material. This is the part where any question that will be posed to the policy makers during the visit get availed to allow ample time for preparation. In addition, the policy makers will get a copy of the policy recommendation report to allow them to prepare for the discussion during the visit. After providing the material in focus, the next stage will involve setting up a date for the visit and the itinerary. The itinerary is generally focused on arrival at the policy makers’ offices and a schedule of the debates that will take place. The itinerary will be approved by both sides (we, the visitors and the policy makers). The visit will last for not more than two hours (Bensley & Brookins-Fisher, 2008). Overview of Recomme ndations The key strategies of the recommendations are proper patient-to-nurse ratio staffing, proper shift managements, and proper overtime management. The importance of these aspects of nursing is that they are the backbone of proper nursing environment. On proper nurse-to-patient ratio, the problem was that nurses in many hospitals were overwhelmed by the work they had to do. In some cases, one nurse had to tend to over sixty patients. This is a dangerous situation because nurses who are overwhelmed by their work get fatigued and, as a result, produce poor quality results (Kenner & Finkelman, 2012). On proper shift management, the problem identified was that nurses had to do very long shifts and in most cases worked on the same working quadrant for a long time. The long shifts made the nurses fatigued and demoralized them. The notion of working in the same quadrant over a long period of time made their work seem repetitive. Repetitive work makes the nurses numb to developments in the workplace. These developments are such as patient condition deterioration or any routine procedures that may need to be changed. My recommendation at this point is that the nurses should work shifts of less than eight hours and that the hospitals should do frequent rotation of the nurses in the wards (Kenner & Finkelman, 2012). On overtime management, the problem identified was that nurses did much overtime work. Daytime nurses tended to stretch their shifts into the night and vice versa. Other nurses took weekend jobs. The problem with overtime work is that it exhausts the nurses and confuses the doctors who will have already changed shifts. My recommendation is that nurses should be allowed as little overtime work as possible due to the nature of their work. Their work is sensitive and demands a lot of keenness (Kenner & Finkelman, 2012). Analysis of Empirical Evidence Empirical evidence showed that nurses who worked for long shifts had alarmingly poor results with many nursi ng related conditions attributed to them. Generally, nurses who worked long shifts complained of loss of concentration in work and stress. Doctors who worked with nurses, who worked long shifts, complained of laxity among those nurses and reduction in the quality of the nurses’ work. The case was worse among nurses who were registered and their unregistered assistants. In such cases, there was a breakdown in communication. Registered nurses who

American Presidency Essay Example | Topics and Well Written Essays - 1000 words

American Presidency - Essay Example In general, each man who has held the position, has faced somewhat similar circumstances while holding the job, but have been forced to approach them from an individualistic standpoint that stays true to their respective convictions, while outlining their legacies in the pages of the history books that future generations will come to read. As for the American Presidency, the following are listed under Article II of the US Constitution in regards to the issue of the role of the office of the Presidency and in particular the tools available to its occupant; Chief Diplomat: Under the Constitution, the president has more authority over foreign policy than the other branches of the government (but not sole authority). The president can negotiate treaties (with consent of the Senate), appoint diplomatic personnel, and has sole power to recognize governments. Commander-in-Chief: The Constitution places the president as the head of the armed forces of the United States. One way to look at this is that he is the general of the generals. This is important because it guarantees civilian control over the military (something missing in many countries of the world). One of the last major challenges to the presidency as commanderin-chief came when General douglas McArthur challenged Truman's policies during the Korean War which led to President Truman's firing of McArthur. Chief Legislator: No bill proposed by the congress can become a law without the president's signature. Thus the president is also involved in the process of legislation. But the Constitution mandates that the president "from time to time" inform the congress on the state of the union (the U.S.). By tradition, this has become a yearly event known as the State of the Union Address. Through this address the president helps to set legislative priorities for the coming year. ("The Presidency", p.1). Different President's come into office at different times during the course of their nation's history. Contrary circumstances that can lead different men in vastly different directions and lead them to having distinct Presidencies in their own right. In regards to what would enable a President to succeed, as well as what could make then fail, "Two hundred years of our country's history suggest that five qualities have been constants in the men who have most effectively fulfilled the oath of office. First, every successful president has had vision, insight, or understanding: a clear idea of

Cyrus Essay Example | Topics and Well Written Essays - 750 words

Cyrus - Essay Example One of King Cyrus’ servants, after being given one of the singing girls, says that, â€Å"I would far rather be serving on this campaign than sitting at home† (Xenophon, 2010). This quote reveals the servant’s loyalty to King Cyrus. He offers loyalty as an appreciation for being given a singing girl. Loyalty is also seen through trust. People trust unquestionably other individuals who are loyal to them. Cyrus sends for his trusted servant, Araspas, whom they have been friends since childhood. King Cyrus entrusts Araspas with guarding the captive Susian woman, Pantheia the wife of Abradatas his rival. Araspas loyalty is earlier doubted when he says, â€Å"have you seen the lady whom you bid me guard† (Xenophon, 2010). This is because he is not sure to fulfill his master’s will fully as he stumbles by falling prey to the captive’s beauty. Love is voluntary to human will. Therefore, beauty should not be compromised to love, but it should only enhance the process of loving someone. The use of metaphor is observed and is majorly used to expound on beauty. Beauty has been equated to â€Å"fire† while love to flowers. This is because â€Å"fire burns all men equally, it is its nature to do so, but these flowers of beauty, one man loves them and another loves them not, nor does every man love the same† (Xenophon, 2010). In contradiction to this statement, Cyrus reiterates the aspect of slavery in relation to love. He gives an instance of men who vowed to stand against every form of life circumstances to remain strong willed and never falls. However, when love knocks their doors to their souls, they fall and even refuse to let go and acknowledge. Love is eternal to human nature since we are bound forever to whoever we choose to love. Our souls are imprisoned by love the moment we allow it to. Xenophon shows th is through rhetoric where Cyrus asks, â€Å"If love be voluntary, why cannot a man cease to love when they forget, the bigger problems they were able to overcome?†

The Changing Global Economy Essay Example for Free

The Changing Global Economy Essay The argument for globalisation is an argument for International trade. Classical liberal economists have always argued for the free movement of all factors of production. Adam Smith had declared that nations have absolute advantaged that they leverage to provide cheaper and more efficient production processes. David Ricardo argues in his theory of Comparative advantages that countries must utilize their relatively more abundant factors of production more intensively to produce higher levels of output. All this results in higher output and therefore the world stands to gain through increased trade. Factor mobility leads to stabilization of prices that result from goods and services moving from one place to another where the factor is scarce and fetches higher returns. Those who are against globalisation and trade base their debates on the infant industry argument which believes that small domestic players get adversely affected when large foreign firms compete. The other argument they make is that that imports cause shifts of production where firms locate to foreign lands and cause unemployment. It is also believed that globalisation leads to the dumping of poor quality or toxic goods across the border. Reliance on imports leads to dependence, and exports cause injury to locally available resources that get diverted to foreign markets. Globalisation is also seen as a phenomenon where the free flow of money and currency makes domestic economies extremely vulnerable to volatile foreign investments. This could lead countries to balance of payment difficulties and cause events such as the East Asian crisis in the mid nineties. What results is a situation where any minor turbulence in large economies like the US causes severe stress to developing and under developed economies. 2. Huntington and the clash of civilizations Huntington’s famous hypothesis states that in the modern world, the clash of ideologies will convert into a clash of cultures. He argues that the new world order will see greater examples of conflict between various cultures of the world. His thesis is seen as a justification of the US war against Islamic nations and its aggression against countries like China. These clashes would come from a conflict that emanates whenever differing cultural paradigms come into contact with each other and compete for global resources. The end of the cold war, according to Huntington, is the end of conflict based on ideology, where the capitalist and the communist bloc were engaged in war. This conflict ended with the collapse of the USSR and the coming down of the Berlin Wall. Today, the emerging economies of the world are growing fast and eroding the huge share in Gross Domestic Product (GDP) of the world that is now held by the western countries. These new and emerging economies are home to most of the cultures of the world that are all opposed to the dominant western thought. This opposition would give rise to global conflict. This is the conflict that Huntingdon terms as the Clash of civilizations that emerges in a world that is globalising at a fast pace. This globalisation is bringing together people from various cultures and this would manifest in a battle for domination. This then would cause conflicts among cultures. Huntington’s hypothesis has been debated endlessly and there are as many voices supporting the argument as there are that characterise Huntington’s theory as mischievous. 3. Institutional arrangements For a free economy, there are certain pre conditions that must be met. These are the protection of property rights, honoring of contracts, law and order and a competitive environment. These pre conditions are met when these are institutionalized. These institutions then enable markets in any state and cause efficiency in market transactions and therefore result in growth. Some of these institutions are put in place by the government by way of regulatory bodies and police forces. Some of these institutions are created simultaneously by a society as it evolves. Markets function best when free and perfect information is available to all players. Competition in an economy comes out of the lack of barriers to entry and exit from the market. Laws and policies that enable such an environment are all referred to as institutional arrangements. In most markets there is asymmetry of information and a differentiated access to factors of production. Such a situation prevents an economy from operating at full potential. Those states that ensure the existence of such institutions are the ones where economic growth takes place to its full extent. Weak institutional arrangements favor some players in a market and adversely affect the rest. Market based solutions to such problems are usually the most sustainable and efficient mechanisms. This gives rise to poor governance structures and cause imperfection. It is not always the state that brings about these institutions. Sometimes institutional arrangements evolve and take firm roots in markets. Such informal institutional arrangements provide players with an eco system that enables innovation and growth. 4. Shifts in the world economy The two factors that clearly set apart the last 25 years of economic growth in the world are the collapse of the Soviet Union and the fast paced changes in technology. Both these events have lead to a globalised world where trade has more than quadrupled. Technological changes, especially the strides made in communication technology and transportation have enabled the world to shrink and become a global village. Transactions are now possible at lightning speeds, at the click of a mouse, between two entities situated in different corners of the globe. What has also been seen is the spurt in trade in services, and such was not the case with the world earlier where all trade was for goods. Free trade has improved the chances of poor countries to enter new business internationally, and allow their firms to buy and sell various commodities and services. Domestic rules and standards become significant and issues such as restrictions on imports, exports, tariffs and duties become significant. (Ohmae, 1999). In all this the new entity that has emerged is that of the Multi National Corporation. MNCs today typically operate in several countries, where the source of raw material is one nation; production takes place in a second country, assembly and packaging in a third and sales in a fourth. This has enabled firms to grow in size and shape and allow economies of scale to reduce costs of production and therefore prices. Most nations in the last 25 years have made currencies convertible and have ensured that internationally agreeable norms and polices are put in place. A large credit for this goes to the World Trade Organisation that has put in place a multi lateral agreement that allows for free trade between members. The MNC has leveraged these changes to emerge as a significant player in world economics. References: 1. Clarke, G.and S. My Vision To Become The Office Manager

My Vision To Become The Office Manager My personal leadership goal to lead my life independently is I put my education first in order to achieve the job of my dreams. I aim to get my education stream ended until NZIM and I aim that in the next 3 months. A job should follow in a year or so and then I can support my family needs as my parents retire than. In life I want to be an easy going in the family and not a Hitler type leader I want a balance of rule and freedom in my surround for myself and for others who are around me. By the next 10 years I want to have my own business which I am comfortable to work as and manage my life well as well as love my work. Skills to Develop My manager is the role model for me and I would like to develop my skills like him, he is so kind and talks politely to all staff and also always use magic words like please with the works and he never get angry with the staff members if they do any mistake but he always try to solve in a silence manner. As well the respected leader whom I would like to emulate is my supervisors she always works as a team with all the staff and always tries to help each other. Some of the skills which I would like to develop are to handle the entire machine at work, have good communication with all staff, and be active at work so that everything is done on time at last is time management . Current leadership frame reference The abilities which I would like to develop to become a leader are to become an excellent speaker and built more confident, develop excellent communication skills and empathy for my followers. I would like to get involve in community work and always find a way to help needy people. Target leadership frame of reference. I am a process worker and my target is to become full time supervisor so that it will built more confident in me and I will be able to reach my desired goals in future, my aim is to learn more things about the restaurant duties and develop my leadership skills in it. Counsel and coach myself to be an effective leader The best way to learn about something is to know how you learn the best and no one is better than me who can know how I prefer learning and what motivates me to learn and make a difference. I want to counsel and coach myself first and gain the confidence needed to be an effective leader; because without confidence it is difficult to achieve goals and when we are confident we will keep trying and not give up. This is the first step before I go further developing a leadership role for myself in life and it should take 2 -3 months if I start now. This process should take long because I need to see the circumstances in life, see them every day and think about my role in it and how I can make a difference. Continuously I will compare my new thoughts with other leaders around to see if they also think like I have been thinking about my role and its importance and if it somewhat similar than would mean I am on right track. Discover new aspects, revolutionised and effective theories about leadership In this approach I want to learn the new ways of leadership in the world. The fact that technology, fashion and way of living for people change overtime, I need to keep up with what works the best today. I cannot guide myself to be a leader using the 50 year old policies and ways because it wont be as effective as it was 50 years ago. This process follows after counselling and coaching myself and should also take 3-4 months as this will involve learning and studying case studies and analysing it. In the end, I can also compare my thinking with the outcomes of the case study and see if I had made decisions instead, what would the outcome had been. If, due my decisions I feel like I would have worsen the case or would make bad choice than it would mean I have a long way more to go. Take the bitter test and lead in the worst circumstance The third step in order is to take the bitter test and this will act like a real life practical approach. Because we always make bad performance when we first time ever do something, this approach will teach me how I perform and where I should improve. But, most importantly this is a bitter test and I will try to lead myself in the worst case scenario like take the tuff case. The reason for taking the bitter test is because however I perform in it I will learn the most because there would be nothing worse than the situation I use to lead myself in. This symbolises the saying that you aim for the stars, you will at least fall on the moon; so even if I fail to lead perfectly in my bitter test, I will actually perform better in least difficult leading task I have and eventually overtime be capable to lead in my leadership roles. This process I think will take 1 2 years depending on what the task is as if it is career than the task will be a long way from now. I will setup a achievement list that has a due date and the activities and abilities with due dates and I should achieve them before the dates specified as this will be a long leadership approach. Consult an experienced leader and learn the gaps The best way to learn my mistakes is to get an individual who is much unbiased while giving me the facts about my abilities. Obviously, whatever decision I make will be based upon my thinking and morally what we think and do, is what we feel is right so it is not possible for me to decide if I am doing the right thing the right way. Getting help from an experienced leader to tell me unbiased gaps in my plan is a good way to fix my mistakes and seal the gaps which is sure to be created by an inexperienced learning leader. Gaps are sure case in every beginning for every leaders career and those gaps are otherwise sealed through experience but, for me to use an experienced leader in my plan, I will be able to minimise those gaps of inefficiency which I will create in the future. This approach should be my second last approach which should take 1 2 months and I will evaluate my progress by frequently visit my chosen leader and take advises and about my experience and he / she will decide how I perform. Be part of a group of leaders to share and learn new things The last and final steps to start the process of making something good out of my life is match and compare my talents with all others in the same field of becoming a good leader for themselves and others in their lives. Because no two leaders are always same into dealing over the same issue, this means we can learn each others way of getting the same result with different acts and perspectives. In this approach I aim to get insights, experiences and learn more techniques that will enhance my abilities further. The brain storm team will include at least 3 people and we will share our knowledge and ideas on how to successfully become good leaders of our life. This approach would be a maximum of 1 month process and I will evaluate the process by making notes and matching it against my choices and perspectives and see what new things I learn everyday from the other learners and once I see that I know other learners actions and we all think like each other as well than that would mean I have successfully completed this process.

Ida B. Wells Essay -- essays research papers

Ida B. Wells was a woman dedicated to a cause, a cause to prevent hundreds of thousands of people from being murdered by lynching. Lynching is defined as to take the law into its own hands and kill someone in punishment for a crime or a presumed crime. Ida B. Wells’ back round made her a logical spokesperson against lynching. She drew on many experiences throughout her life to aid in her crusade. Her position as a black woman, however, affected her credibility both in and out of America in a few different ways.   Ã‚  Ã‚  Ã‚  Ã‚  Her parents nurtured the background of this crusader to make her a great spokesperson. She also held positions throughout her life that allowed her to learn a lot about lynching. She was fueled by her natural drive to search for the truth. Wells was born into slavery in Holly Springs, Mississippi. Her father, James Wells, was a carpenter and her mother was a cook. After the Civil War her parents became politically active. Her father was known as “race'; man, a term given to African Americans involved in the leadership of the community. He was a local businessman, a mason, and a member of the Board of Trustees of Shaw University. Both parents provided Ida with strong role models. They worked hard and held places of respect in the community as forward-looking people. James and Elizabeth (mother) Wells instilled their daughter a keen sense of duty to God, family, and community. Ida’s background was strengthene...
